Terms of Service

These Terms of Service ("Terms") govern your use of Outreach-MCP (the "Service"), operated by 42nights ("we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Outreach-MCP is a cold-email outreach pipeline you drive through Claude: it scrapes prospects, scores them against your ideal-customer profile, finds and verifies email addresses, and sends your email sequences through accounts you connect (such as your own Gmail).
2. Your account & license
Access requires a valid license key. You are responsible for keeping your key confidential and for all activity conducted under it. You must provide accurate billing information and keep it current.
3. Acceptable use & your compliance obligations
You are solely responsible for the messages you send and the recipients you target. You agree to comply with all applicable laws and regulations governing email and outreach, including the U.S. CAN-SPAM Act, the GDPR, and similar laws in your recipients' jurisdictions. You will:
- send only to recipients you are lawfully permitted to contact;
- identify yourself truthfully and include a valid physical address and opt-out where required;
- honor unsubscribe and deletion requests promptly;
- not use the Service for spam, harassment, fraud, malware, or any unlawful, deceptive, or abusive purpose.
You must also comply with the terms of any connected account (including Google's and Gmail's sending limits and policies) and any third-party data provider's terms.
4. Connected accounts
When you connect Gmail, you authorize us to send email on your behalf using send-only access. You may revoke this access at any time via your Google Account permissions; revocation stops further sending through that account.
5. Fees
Fees, if any, are described at the time of purchase and processed by Stripe. Except where required by law, fees are non-refundable.
6. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that lead data or email verification results are accurate or complete, or that the Service will be uninterrupted or error-free.
7. Limitation of liability
To the maximum extent permitted by law, 42nights will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amounts you paid for the Service in the twelve months preceding the claim.
8. Indemnification
You agree to indemnify and hold 42nights harmless from any claims, damages, or expenses arising from the messages you send, the recipients you target, or your breach of these Terms or applicable law.
9. Suspension & termination
We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to others or to the Service. You may stop using the Service at any time.
10. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising under these Terms.
11. Changes
We may update these Terms; material changes will be reflected by a new effective date above. Continued use after a change constitutes acceptance.
